Don't Let Debt Have an Extreme Hold on Your Life Bankruptcy is not the right answer for everyone, but it could be right for you.

Wichita Collections Defense Attorney

Are You Being Pursued for Debts in Kansas?

It is not pleasant to be the target of collections agents. This can mean harassing phone calls, law suits, raids on your bank account, wage garnishment and repossessions. The most important thing to know is that you have rights and there are things you can do to help yourself. As there are many varying circumstances and defenses, you are advised to contact a bankruptcy lawyer in Kansas for guidance.

The Fair Debt Collection Practices Act lays out a code of rules that collection agents must follow. For instance, they may not call before 8:00 a.m. or after 9:00 p.m. If you give them a written request, they must even stop calling you unless they have something important to tell you. They are also prohibited from contacting you directly once they learn you are represented by an attorney. If they violate any of these rules, it is you who may sue them!

Defenses against Debt Claims

You may have a valid defense against their claim. The debt contract may have involved misrepresentation or be too old or violate the Truth in Lending Act. If you have been sued, it is vital that you contact an attorney immediately so he may act before legal deadlines.

Bankruptcy

Your ultimate weapon is Bankruptcy. You may do this only once every six to eight years so it is not to be done lightly. If you believe you could pay off debts if given time, you may file under Bankruptcy Chapter 13 where you present a plan to pay off your debts over a three to five year period. Once you file for Bankruptcy all collections actions against you must cease. If you do not think you could even do a payment plan, you may qualify for Bankruptcy Chapter 7 where your debts are simply cancelled.
