Don't Let Debt Have an Extreme Hold on Your Life Bankruptcy is not the right answer for everyone, but it could be right for you.

Alternatives to Bankruptcy in Wichita

Are You Having Trouble with Creditors But Don't Want to File Bankruptcy?

Alternatives exist to bankruptcy when you are having difficulty with debts. You may be able to stop creditor harassment by use of the Fair Debt Collection Practices Act. Debt reduction may be achieved by negotiation with the creditor. You are urged to contact a Kansas bankruptcy attorney for help with alternatives to bankruptcy.

Harassment by Creditors

The Fair Collection Practices Act governs what debt collectors may and may not do. If debt collectors violate these rules, they may be sued in court for damages plus reasonable attorney fees.

Among the prohibited actions are:

  • Calling before 8 a.m. in the morning or 9:00 p.m. at night
  • Failing to stop calling after being asked to in writing. At this point the debt collector must stop calling unless to communicate significant action such as that a lawsuit is being commenced.
  • Contacting a debtor at his place of employment after being told that is unacceptable.
  • Contacting a person known to be represented by an attorney.
  • Causing a phone to ring continuously.
  • Using rude or profane language.

It may be possible to work out a settlement with a creditor. For instance, you may be able to sell some assets and then offer a creditor a lump sum in exchange for a reduction in the debt.
